Term: delivery (writ of)

1.

If a court order is made to deliver up goods in satisfaction of a judgment and the judgment does not permit the debtor to pay the assessed value of the goods, the judgment debtor may be entitled to take advantage of the enforcement procedure to enforce compliance with the order. The judgment creditor may apply for a writ of specific delivery to obtain possession of the goods in satisfaction of the judgment.

In the event that the order permit delivery of the goods or the payment of their assessed value, the judgment creditor may be entitled to obtain a writ of delivery to enforce the order.

Usage: The judgment creditor applied for a writ of delivery to enforce the judgment.
