Legal Phrases
Term: lending right
1.
Lending of a copy of sound recordings, films, certain books and computer programs means making a copy of the work available for use through an establishment accessible by the public in which a person does not receive direct or indirect remuneration that goes beyond what is necessary to cover the operating costs of the lending facility.
The right to control the lending of copies of certain works is protected by copyright. Thus in relation to sound recordings, films, certain books and computer programs, copright grants an exclusive right to copyright owners to permit the issue of copies of works to the public thereby exercising their lending right.
Usage: An library owns a DVD containing a film and exercises the lending right by renting the DVD to a member of the library.
