Graphic works are a category of artistic work, and is defined in section 4(2) of the Copyright, Designs and Patents Act 1988 UK to include a painting, drawing, diagram, map, chart, plan, engraving, etching, lithograph, woodcut or similar works.
These terms generally take their ordinary English meaning, however where the particular meaning is too restrictive their ordinary meanings are extended to grant the coverage contemplated by the Act. Maps, plans and charts also cover fictional artistic works.
Although graphic works are a form of artistic work under the Act, graphic works created in commerce also qualify for protection.
Technical drawings of industrial objects typically qualify for protection, such as screws, engine blocks, gearboxes and agricultural equipment.
Protection as an artistic work may overlap with registered trade mark or unregistered trade marks, provided there is sufficient originality in the artistic component of the trade mark.
Usage: The drawing qualified for copyright protection as a graphic work.
