Term: counterclaim

A counterclaim is a claim made by a defendant in response to the claimant’s claim. Counterclaims are usually made in conjunction with the defence in the legal proceedings. They are made under Part 20 of the Civil Procedure Rules, and that Part of the CPR governs their requirements.
The counterclaim need not relate to the subject matter of the claim made by the claimant.
Usage: The counterclaim was filed with the defence in the proceedings.
