Term: judicial notice

Judicial notice is a reference to the ability of a tribunal or court to accept a fact without formal proof on the basis that the the fact is within its general knowledge.

Instances may include:

  1. That Marks and Spencer plc is a major UK retailer.
  2. Investments that entail higher risk also attract higher rates of return.
  3. Where the meaning of words is concerned, a dictionary may be referred to ascertain the meaning where ambiguity or uncertainty exists.

Usage: The Interpretation Act 1978 provides that Acts of Parliament shall receive judicial notice.
