Term: evidential burden
1.
The evidential burden is that there must be some evidence of an asserted fact in order to formally prove that fact and to be considered by the tribunal of fact in the course of litigation, in order to prove the fact.
Usage: The claimant failed to adduce any evidence of the alleged cotract and this failed to discharge the evidential burden.
